Compliance alert: Make sure these 3 labor law posters are visible to job applicants
As employees return to the office, you may need to update the various federal labor law posters you have to conspicuously display in the workplace. By law, employers must update these posters regularly so employees can see them and know their rights.
But did you know there are also three labor law posters employers must put in a place that new applicants can see?
In the HRMorning.com webinar “6 Overlooked Posting Requirements That Could Put Your Company at Risk,” Dr. Jim Castagnera, the president of Dr. Jim’s One-Stop HR Shop, said: “If you’ve got applicants coming in to HR applying for a job, make sure these posters are in a place that not only will your current employees be able to see them – so you can satisfy that requirement – but you also satisfy the requirement that you can say, ‘Yes, the applicants passed by those posters. They had an opportunity, while waiting in the waiting room … to see those posters.'”
3 labor law posters mandatory
Castagnera said that whether it’s in a lobby or your hiring manager’s office, all prospective employees need to have some kind of opportunity to read the following labor law posters to stay out of hot water with the Dept. of Labor (DOL):
- Equal Employment Opportunity (EEO) is the Law. According to the DOL, the display must include the 2015 EEO Supplement and the Pay Transparency Nondiscrimination Provision. It’s also important to ensure that representatives of any labor organizations you have collective bargaining agreements with have this documentation.
- Employee Rights and Responsibilities Under The Family and Medial Leave Act.
- Employee Polygraph Protection Act (EPPA) Protection Notice. Remember, the EPPA applies to prospective employees regardless of their citizenship status.
Like many employers, your hiring process may now be 100% online for certain employees. To stay in compliance, you should have electronic versions of the notices posted on your intranet in a conspicuous location and links to the notices that can be sent to job applicants.
Keep in mind that electronic posting can’t take the place of physically putting up labor law posters.
Because failure to hang these posters may result in costly fines, or possibly even a civil lawsuit, it’s a smart idea to huddle up with HR to ensure they’re on-premise and visible to people who want to work for your company.
