Employer’s Reinstatement Failure Carries $3.66M Price Tag
How much might an employer have to pay when it fails to reinstate striking employees?
NLRB Region 6 has approved a $3.66 million settlement with Langeloth Metallurgical Co. It resolves allegations that the company failed to reinstate, or delayed reinstating, former strikers after their union made an unconditional offer to return to work in September 2021.
Back Pay, Front Pay and More
The $3.66 million settlement provides relief to 51 former strikers determined to be eligible for reinstatement, including:
- 100% of Region 6’s calculated monetary damages to date, including back pay, missed 401(k) contributions, reimbursable expenses, interest and compensation for adverse tax consequences associated with lump-sum back pay awards, and
- An additional $1.275 million in front pay for several former strikers who elected to waive immediate reinstatement.
